Terms of Use
These terms are the agreement between you and Tokra, LLC for using Tamoora.
Agreement
These Terms of Use are a legally binding agreement between you and Tokra, LLC, a Delaware limited liability company (“we”, “our”, “us”). By creating a family account or using Tamoora you agree to them, and to the Privacy Policy, the Children’s Privacy Notice, the Cookies and Storage policy and the Cancellation and Refund Policy. If you do not agree, please do not use Tamoora.
They apply in the same way on tamoora.com and in any Tamoora app, and they are also the end-user licence for those apps. The English text is the controlling version.
The service
Tamoora is a learning app for children. A parent or guardian creates a family account and adds children; each child learns in the app while their progress is saved to the family account. Content is suggested from age 4.
Tamoora supports learning; it does not replace school, a teacher, or professional advice. We improve Tamoora over time and may add, change or remove features. If we remove something important that you pay for, we will tell you in advance.
The academy’s AI teacher and Tamoora, the app’s companion, are computer programs. In a family’s account, they talk with a child, in writing and by voice, only after a parent said yes for that child, within a number of turns and minutes a day. Someone trying Tamoora without an account can talk with Tamoora in the visitor’s tour after agreeing on the screen that says so, and can take a lesson by voice on tamoora.com/learn after tapping to start it, as the Privacy Policy describes under «Trying Tamoora without an account». They can make mistakes: treat them as learning aids, and check what matters with a teacher or a trusted source.
Who may use Tamoora
A family account may be created only by an adult (18, or the age of majority where you live) who is the parent or legal guardian of the children added, or who acts with their authority.
Children use Tamoora inside the family account. The parent or guardian accepts these Terms on the child’s behalf and supervises the child’s use.
Your family account
- Give true details and keep your password private. You are responsible for what happens in your account.
- You may invite other adults to your family. The account owner stays responsible for them and can remove them at any time.
- You can set a parents’ PIN so that only adults open the family’s settings.
- Tell us at once at support@tamoora.com if you think someone else has used your account.
Plans, trial and payment
- A new family starts with a free trial, for the number of days shown on tamoora.com. When it ends without a plan, the app pauses until you choose one; your family account and your children’s saved progress are kept.
- Plans are paid on the web through Stripe, or in Tamoora’s iPhone and iPad app through Apple, by the month or by the year. Before you pay, you see the price, the billing period and how renewal works. A subscription renews automatically at the end of each period until you cancel it.
- A family’s plan is priced by its number of children (up to three). For a plan paid on the web, before a child is added, or brought back, beyond the number the plan is priced for, the account owner sees the new price and what is charged now, and agrees to it. The plan then moves to the new price at once, and the difference for the rest of the period already paid is charged then; nothing is charged now during free days, or for a number of children already paid for in that period. If your bank asks to confirm the payment, you complete it on Stripe’s page and then add, or bring back, the child again; if it is not paid within 23 hours, nothing changes. Hiding or deleting a child lowers the price from the next renewal, and nothing is refunded for the period already paid.
- If you choose a plan on the web during the free trial, the free days you have left are kept, and the first payment is taken when they end. A plan may also begin with free days of its own, shown before you pay; a family has free days only once.
- For a plan paid on the web, the account owner can change the plan or the billing period, update the payment method, see the invoices, or cancel, at any time in the family account: Settings › Plan › Manage billing and invoices. A change to a higher price or a longer period takes effect at once, with the time left in the period already paid counted toward it; a change to a lower price or a shorter period takes effect at the next renewal. A cancellation takes effect at the end of the period already paid.
- A plan bought in Tamoora’s iPhone or iPad app is sold by Apple, at the price the app shows from Apple for your country’s store, by the month or by the year. Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically at the same price for the same period unless it is cancelled at least 24 hours before the end of the current period, and the renewal is charged within the 24 hours before the period ends. Only the account owner can buy it, on the parents’ own device, in the family area the parents’ PIN opened. It covers the number of children it names; for more children, the account owner chooses the plan for that number in the app (Settings › Plan), and Apple moves the subscription under its rules. Bought during the free trial, it starts, and is charged, at once. Manage or cancel it at any time in the app (Settings › Plan › Manage subscription) or in your iPhone or iPad Settings › your name › Subscriptions; a cancellation takes effect at the end of the period already paid. Refunds for it are Apple’s to decide, as our Refund policy describes.
- A family has one plan at a time: a plan paid on the web is changed on the web, and one bought through Apple is changed in the app or at Apple. A purchase made inside a Tamoora app through Google Play is billed by Google Play under its terms, and is managed and cancelled there.
- We will tell you in advance of any price change. It applies from your next renewal, and you can cancel before then. For a plan bought through Apple, Apple also tells you, and asks for your agreement where its rules require it.
- Prices are shown in Saudi riyals and include VAT at 15%; elsewhere, taxes are included or added as the law of your country requires, and are shown before you pay. In the iPhone and iPad app, the price is Apple’s for your country’s store, in its currency, with the taxes Apple includes.
- Refunds are set out in the Cancellation and Refund Policy.
Acceptable use
You agree not to:
- use Tamoora against the law or to harm anyone;
- try to reach another family’s account or data;
- copy, resell, scrape or redistribute Tamoora’s content;
- reverse-engineer, overload or disrupt the service, or get around its limits or security;
- enter offensive or unlawful words in names or anything else you type.
Ownership and licence
Tamoora, its lessons, stories, characters, pictures, sounds, design and software belong to Tokra, LLC or to those who licensed them to us. Some educational texts come from third parties under their own licences — for example the Qur’an text from Tanzil and hadith from HadeethEnc — and those licences apply to them.
We give your family a personal, non-exclusive, non-transferable and revocable licence to use Tamoora for its own learning, not for commercial use.
What your family enters, and your children’s progress, remain yours. You allow us to store and process them only to provide Tamoora to you, as the Privacy Policy describes.
Other services
Tamoora relies on the service providers named in the Privacy Policy. Tamoora shows no advertising. We are not responsible for websites or services we do not control.
Disclaimers
Tamoora is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that Tamoora will be uninterrupted or free of errors, or that a child will reach a particular result.
Limitation of liability
To the extent the law allows, Tokra, LLC is not liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim relating to Tamoora is limited to the greater of (a) the amount you paid us for Tamoora in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD 100).
Nothing in these Terms limits liability that the law does not allow to be limited — such as for death or personal injury caused by negligence, or for fraud — or your rights as a consumer under the law of your country.
Indemnity
To the extent the law allows, you will hold Tokra, LLC harmless from claims by others that arise from your breach of these Terms or your misuse of Tamoora. This does not apply where the law of your country forbids it for consumers.
Ending the agreement
You can stop using Tamoora and delete your family account at any time in Settings. We may suspend or close an account that seriously or repeatedly breaks these Terms, or where the law requires it; unless the law or a child’s safety prevents it, we will tell you first and give you the chance to download your data. When an account is closed, its data is deleted as the Privacy Policy describes.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Talk to us first: write to legal@tamoora.com, and we will try in good faith to resolve the matter within 60 days.
If it is not resolved, the dispute will be settled by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in Wilmington, Delaware or by video, in English. Either of us may instead bring an individual claim in a small-claims court. Claims may be brought only individually, not as a plaintiff or class member in any class or representative action.
If you are a consumer in the European Union or the United Kingdom, or wherever local law gives you this right, you keep the protection of the mandatory laws of your country and may bring claims in its courts; the arbitration and class-action waiver above do not apply to you.
Apple and Google
If you get a Tamoora app from the Apple App Store or Google Play:
- these Terms are between you and Tokra, LLC, not Apple or Google, and Tokra, LLC alone is responsible for the app and its content;
- the store has no duty to provide maintenance or support for the app;
- if the app fails to conform to a warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation for the app;
- Tokra, LLC, not Apple or Google, is responsible for any claim about the app, including product liability, legal or regulatory compliance, consumer protection and intellectual-property infringement;
- you confirm that you are not in a country subject to a U.S. Government embargo and are not on a U.S. Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to these Terms
We may update these Terms. We will post the new version here with its date and, for a significant change, tell you in advance by email or in your family account. If you keep using Tamoora after a change takes effect, the new Terms apply; if you do not agree, you can delete your account.
General
These Terms and the documents they name are the whole agreement between you and us about Tamoora. If part of them cannot be enforced, the rest stays in force. Not enforcing a right is not a waiver of it. You may not transfer these Terms; we may transfer them to a company that takes over Tamoora, with the same protection for your data. We are not responsible for delays caused by events beyond our reasonable control.
